1.3. If you do not agree to all these Terms, you must not use our services. We may update these Terms at any time, and continued use of our services indicates acceptance of the updated Terms.
2. Term and Termination
2.1. These Terms remain in effect as long as you use our services or until terminated in accordance with these Terms.
2.2. You may stop using our services at any time by discontinuing contact with us.
2.3. We may suspend or terminate providing services to you if you are not complying with these Terms or if your actions could cause legal liability or disrupt others’ use of our services.
2.4. We may change or discontinue certain services by providing reasonable notice. Upon termination, any rights to use our services will cease immediately.
2.5. Certain clauses, including those related to indemnification, will survive termination.
3. Use of Services
3.1. We provide services to assist you with energy solutions, rebates, and related matters. You may contact us to receive quotes, advice, and support in obtaining rebates and performing energy-related activities.
3.2. You must not misuse our services for unlawful purposes or in breach of these Terms.
3.3. We do not guarantee that our services will always be available or free from disruptions.
4. Your Responsibilities
4.1. You are responsible for providing accurate and up-to-date information when engaging our services.
4.2. You must comply with all relevant laws and regulations when using our services or performing any related activities.
4.3. You are responsible for the proper performance of any services you undertake with our assistance, including obtaining necessary licences, insurance, and certifications where required.
5. Updates to Services
5.1. From time to time, we may update or modify the services we provide. We will notify you of significant changes that may impact your use of our services.
6. Service Performance
6.1. You are solely responsible for the performance of any energy-related services you undertake, including complying with all industry standards, laws, and regulations.
6.2. You must ensure you hold the necessary insurance, including public liability insurance and workers' compensation, where applicable.
7. Separate Agreements with Clients
7.1. If you engage in providing services to clients based on our advice or assistance, those agreements are between you and your clients. VIC Energy Solutions is not responsible for your contracts with clients.
7.2. You must ensure that services provided to clients meet industry standards and comply with any relevant regulations.
8. Rebates
8.1. We will use reasonable efforts to assist you in obtaining energy rebates for services provided. However, we do not guarantee any specific rebates or outcomes.
8.2. Rebates are contingent upon proper completion of services and submission of required documentation to the relevant authorities.
9. Liability
9.1. We are not liable for any indirect or consequential losses or damages resulting from your use of our services or your agreements with clients.
9.2. Our liability is limited to re-supplying the services or reimbursing you for the cost of services, as allowed under Australian Consumer Law.
10. Confidentiality
10.1. All information exchanged between you and us must be treated as confidential and must not be disclosed to third parties without prior written consent, except where required by law.
11. Disputes
11.1. If a dispute arises, both parties will attempt to resolve it in good faith. If unresolved after 14 days, the matter may be referred to mediation.
12. Miscellaneous
12.1. We may amend these Terms by posting updates on our website or providing you with notice. You are bound by the version of the Terms in effect at the time you engage with us.
12.2. These Terms are governed by the laws of Victoria, and any disputes will be subject to the jurisdiction of Victorian courts.
